Is trademark monitoring worth doing for a growing business?
Our business has been growing steadily, and recently I started thinking about something we probably should have considered much earlier: keeping an eye on how our trademarks are being used. Until now, we mostly focused on registering the name and making sure our own branding was consistent. I assumed that would be enough, but now I’m seeing more companies with similar names and occasional references to brands that look surprisingly close to ours. I’m not a legal expert, so I’m wondering how businesses usually handle this. Is it realistic to monitor potential trademark conflicts manually, or would using a trademark monitoring service be a more systematic approach?

I think manual searches can work as an occasional check, but they become difficult to maintain once the business and brand portfolio grow. The main advantage of a systematic approach is that you can keep track of potentially relevant applications, registrations or other developments that deserve closer attention instead of relying on someone remembering to perform a search every few months. One thing I learned is that monitoring isn’t necessarily about assuming every similar name is a problem. It’s more about finding potentially relevant cases early enough to review them properly. I’d also keep records of the marks, jurisdictions and classes that matter to the business. That makes the process much more organised than randomly searching the internet whenever someone happens to notice a similar brand.
